Limited Warranty and Limitations and Exclusions
LIMITED WARRANTY
"We","our", and "us" refer to SUN-DOR-CO
(A Kansas corporation), 901 South Spencer, Newton, Kansas 67114."You"
refers to any purchaser of our doors, in the ordinary course of business,
within one year from the date the doors are shipped from our factory.
We grant you the following limited warranty: our doors will be
of good material and workmanship and will be free of defects which would
make them unserviceable or unfit for ordinary and recommended use.
This limited warranty is valid for one year from the date each door is
shipped from our factory, and it is subject to the following terms and
conditions.
You must inspect each door when you receive it and before it is hung
or fitted. If you find a defect in any door, you must notify us in writing
within 30 days of the date you received the door describing the defect
to us. If a defect could not be discovered until after the door is hung
or fitted, you must notify us in writing within one year of the date the
door was shipped from our factory describing the defect to us.
If any door is found by us to contain defects as stated herein during
the warranty period,we at our option will do one of the following:
- Repair the defect;
- Furnish you a replacement door, provided that the original door is
returned to our factory; or
- Refund you the amount we were paid for the original door after we
receive the original door at our factory. If we elect option 2 or 3,
the door may be shipped to us at our expense. We will furnish you shipping
instructions.
Under no circumstances will we pay for any cost of installing, finishing,
or removing any door, nor are we responsible for any consequential damages.
LIMITATIONS AND EXCLUSIONS
- Unsatisfactory service or appearance caused by failure to follow
the "CARE, HANDLING, JOB FINISHING AND INSTALLATION
INSTRUCTIONS" set forth herein are excluded from this warranty.
- The appearance of finished doors is excluded from this warranty.
- Natural variations in the color or texture of wood are not to be considered
defects.
- Warp shall not be considered a defect unless it exceeds 1/4 inch in
the plane of the door itself. Warp is any distortion in the door itself
and does not refer to the relationship of the door to the frame or jamb
in which it is hung. The term "warp" shall include bow, cup
and twist. Measuring the amount of warp in a door, the following method
shall be used: bow, cup and twist shall be measured by placing a straight-edge
on the concave face of the door at any angle (i.e. horizontally, vertically,
diagonally), with the door in its installed position. The measurement
of bow, cup and twist shall be made at the point of maximum distance
between the bottom of the straight-edge and the face of the door.
- All the following doors are excluded from this warranty:
- (a) 1-1/8" thick doors which are wider than 3'0" or
higher than 7'0".
- 1-3/8" thick doors which are wider than 3'0" or higher
than 7'0".
- 1-3/4" thick doors which are wider than 3'6" or higher
than 8'0".
- 2-1/4" and thicker doors which are wider than 3'-6"
or higher than 10'-0".
- Doors with face veneers of different species.
- Doors that are improperly hung or do not swing freely.
- Western Pine, Fir and Genuine Mahogany doors with panels over
27" in width.
- Hardwood doors, except Genuine Mahogany doors, with panels over
17" in width.
- Hardwood doors, except Genuine Mahogany doors, used in exterior
applications.
- Louver doors used in exterior applications.
- Exterior doors installed in locations that allow them to receive,
either direct or indirect moisture wetting.
- Doors with mitered rim panels used in exterior applications.
- Doors shipped outside the contiguous 48 United States and District
of Columbia.
- Any implied warranty shall be limited in duration to the period of
this warranty and to the remedies specified herein.
- We shall not be liable for any doors repaired, returned or replaced
without our prior written consent.
